ఎయిడెడ్ కాలేజీ మేనేజ్మెంట్ చట్టవ్యతిరేకమైన చర్యల్ని కమీషనర్ నియంత్రించాలి! ఆర్జేడీ జవాబుదారి

ఆర్జేడీ, కమీషనర్లు ఎందుకు కళాశాల కరస్పాండెంట్లకు వంతపాడుతున్నారు?

The Andhra Pradesh Recognised Private Educational Institutions (Control) Act, 1975 (Act No.11 Of 1975),

Chapter 1,Preliminary,2.Definetions, 1 Point:

2. Definitions - In this Act, unless the context otherwise requires-

(1) "competent authority" means any authority, officer or person authorised by the Government by notification, to perform the functions of the competent authority under this Act for such area or in relation to such class of private educational institutions, as may be specified in the notification.

A.P. Education Act 1982(Act No.1 Of 1982), Chapter 1, Preliminary, 2. Definetions, 12 Point:

(12) "competent authority" means any person, officer or authority authorised by the Government by notification to perform the functions of the competent authority under this Act for such area or for such purposes as may be specified in the notification;

G.O. Ms. No.29, Education (Rules), dated 5th February, 1987, 2. Definetions (1) (D):

"Competent Authority' means the authority which is competent to grant permission/recognition/affiliation as the case may be to the educational institutions;"

Andhra Pradesh Educational Institutions (Parent Teachers Association) Rules, 1987,Published vide Noitification G.O. Ms. No. 246, Education, (Rides) dated 17-10-1987 ,Published in Andhra Pradesh Gazette R.S. to Part 1, Extraordinary, dated 3-11-1987: Rules: 2. Definitions - (1) (c) "Educational Institution" means the school and/or college functioning under the Government/local body/private management (aided or unaided including Registered Schools) recognized by the competent authority;" & Andhra Pradesh Private Institutions Employees Disciplinary Control Rules, 1983, G.O.Ms.No. 467

(2) ఎయిడెడ్ వ్యవస్థలో అపాయింటింగ్ అథారిటీ గూర్చి చట్టం ఇంత స్పష్టంగా చెబుతుంటే ఆర్జేడీ, కమీషనర్లు ఎందుకు కళాశాల కరస్పాండెంట్లకు వంతపాడుతున్నారు?

Andhra Pradesh Educational Institutions (Establishment, Recognition, Administration and Control of Institution of Higher Education) Rules, 1987, Published vide Notification G.O. Ms. No. 29, Education (Rules) dated 5th February, 1987,

7 (1) Staff Pattern గూర్చి వివరించగా,

(2) Appointment of teaching and non-teaching staff నియామకాల గూర్చి (a)(b)(c)లలో మరింత వివరంగా రాయబడింది.

(3) Competent authority for approval of appointments అనే అంశంలో ఏ విధంగా ఆ నియామకాలను కాంపిటెంట్ అథారిటీ అప్రూవల్ చేయాలో రాయబడింది.

(4) Payment of Salaries to staff ఉద్యోగిగా విధుల్లో చేరిన తర్వాత ఆ ఉద్యోగికి ఏవిధంగా జీతాలు చెల్లించబడతాయో వివరించడం జరిగింది.

"మేము జీతాలు మాత్రమే ఇస్తాము... అంతా మేనేజ్మెంట్ దే" అని బహిరంగంగా కమీషనర్ గారు అనడంలో ఆ మర్మమేమిటో ఎయిడెడ్ ఉద్యోగులకు చెప్పాలి!

(3) ఏ చట్టం చెబుతోంది... అధికారుల అనుమతి లేకుండా ఎయిడెడ్ కళాశాల మేనేజ్మెంట్ తీర్మానం చేసుకుని

~ఒక ఉద్యోగస్తుడ్ని సరెండర్ చెయ్యమని...

~ఎయిడెడ్ పోస్టు తెలుగు సబ్బెక్టు వద్దని, సంస్కృతం పెట్టుకోమని..

ఒక ఉద్యోగస్తుడ్ని సర్వీస్ డిస్మెస్ చేయమని.. ఏ చట్టం చెబుతోంది?

అనకాపల్లి, ఏ.ఎం.ఏ.ఎల్. కళాశాల ఇన్ని అక్రమాలకు తెగబడుతుంటే...

ఆర్జేడీ, కమీషనర్, ప్రిన్సిపల్ సెక్రెటరీ, విద్యాశాఖ మృతులు ఏం చేస్తున్నారు?. వారెందుకున్నట్లు? విద్యా చట్టాలెందుకు?

(4) G.o. Ms. No. 42 తో ఎయిడెడ్ స్టాఫ్ విల్లింగ్ ను పరిగణనలోకి తీసుకోవాలి.

(5) ఏ.పి. ఎడ్యుకేషన్ ఆక్ట్-1982, సెక్షన్ 79 (1)కు విరుద్ధంగా మేనేజ్మెంట్ చేసిన సస్పెన్షన్, డిస్మిసల్ కు కాంపిటెంట్ అథారిటీలైన ఆర్జేడీ, కమీషనర్ల అనుమతులేవి ?

Dismissal, removal or reduction in rank or suspension, etc., of employees of private institutions: - (1) No teacher or member of the non-teaching staff employed in any private institution (hereinafter in this Chapter referred to as the employee') shall be dismissed, removed or reduced in rank except after an enquiry in which he has been informed of the charges against him and given a reasonable opportunity of being heard in respect of those charges:

[Provided that no order of dismissal, removal or reduction in rank shall be passed under this sub-section against an employee other than an employee of a minority educational institution without the prior approval of such authority or

Officer as may be prescribed for different classes of private institutions;....]

తమ అనుమతి తీసుకోకుండా మేనేజ్మెంట్ చేసిన సస్పెన్షన్, డిస్మిసల్ పై ఆర్జేడీ, కమీషనర్లు చర్యలు తీసుకొనకపోవడం మేనేజ్మెంట్ తో చేతులు కలపడమే!

~73 రోజులు అక్రమ సరెండర్ తో ప్రభుత్వ ధనం వృధా!

~2 నెలల అక్రమ సస్పెన్షన్ తో ప్రభుత్వ ధనం వృధా!

~ 2 సం. క్రితం తెలుగు సబ్జెక్ట్ తీసినా కూర్చోబెట్టి జీతాలు...

- మేనేజ్మెంట్ తెలుగు సబ్జెక్ట్ తీసివేసిన కారణంగా వర్క్ లోడ్ లేదని, వేరే కళాశాలకు మార్చమని...బోధనా బాధ్యతలు కల్పించమని కోరుతూ ఎన్నో లేఖలు రాసినా స్పందించని కమీషనర్, ఆర్జేడీలు మేనేజ్మెంట్ చట్టవ్యతిరేక చర్యలతో చేతులు కలిపి లక్షలాది రూపాయల ప్రజాధనాన్ని వృధా చేశారు.
